Fire Investigations and Those Nasty Litigation Situations
Presentation by ASSE Region II V.P. James G. Gallup, P.E., CSP

From time to time safety professionals are asked to serve as expert witnesses in law suits. Serving as an expert witness is an art form that has rules, boundaries, and best practices that are not easily found in a literature search. This presentation describes the art of serving as an expert witness based on a fire investigation model. The presentation takes the student from preparation through the investigation, analysis, depositions and ultimately testifying at trial. The presentation also addresses the special issues of Daubert v. Merrill Dow, spoliation, and standard of care.

James G. Gallup, P.E., CSP is a Sr. Fire Protection Consultant for Rolf Jensen & Associates, Inc., the largest fire protection engineering consulting firm in the Country. He holds a BS Degree in Fire Protection and Safety Engineering from the Illinois Institute of Technology. He is a member of the Society of Fire Protection Engineers, the National Fire Protection Association where he serves on the sprinkler standard, NFPA 13, and is a member of the American Society of Safety Engineers. He was recently elected as the ASSE Region II Vice President. He is a registered Professional Engineer in 4 states and is a Certified Safety Professional.

SFPE-RMC Fire Risk Assessment Seminar

November 19-20, 2008 - Parker-South Metro Fire Rescue Authority

Sponsored by the Rocky Mountain Chapter of the Society of Fire Protection Engineers.

Every year, the United States experiences more than 1.5 million fires that claim the lives of more than 3,400 civilians and over 100 responders and results in excess of $1.4 million in fire loss, according to statistics gathered by the National Fire Protection Association. Such statistics are often cited as the basis for the provision of fire and life safety measures. However, dwindling resources, reductions in funding and competition
from other safety needs are resulting in a closer examination of the benefits resulting from the implementation of costly efforts to improve fire and life safety.

Cost-benefit analyses are often used to decide which measures should be employed. But the leap from statistics to cost-benefit analysis can circumvent the necessary step of risk assessment. Risk is broadly defined as the combination of hazard and consequence. The evaluation of risk can provide improved perspective on the issues of concern, the consequences of implementing specific solutions and the benefits derived from proposed solutions.

This seminar is intended for fire protection engineers and individuals interested in the
application of risk assessment in fire protection design. The seminar is geared toward fire and life safety aspects of building design, however the lessons learned will be applicable to a wide range of industrial and community conditions. The methodologies are standard practice in risk analysis and will be useful for many other applications. Experience in probability and statistics is not necessary, but helpful.
